The European Community as the owner of the EGNOSEuropean Geostationary Navigation Overlay Service System and ESSP SAS as its operator expressly disclaim all warranties of any kind (whether express or implied) with respect to the Open Service, including, but not limited to the warranties regarding availability, continuity, accuracy, integrity, reliability, fitness for a particular purpose or meeting the users’ requirements.
No advice or information, whether oral or written, obtained by a user from the European Community or ESSP SAS shall create any such warranty.
By using the EGNOSEuropean Geostationary Navigation Overlay Service SISSignal In Space, the user agrees that neither European Community nor ESSP SAS shall be held responsible or liable for any direct, indirect, incidental, special or consequential damages, including but not limited to, damages for interruption of business, loss of profits, goodwill or other intangible losses, resulting from the use of, misuse of or the inability to use the EGNOSEuropean Geostationary Navigation Overlay Service SISSignal In Space.
WARNING FOR CIVIL AVIATION AND OTHER SAFETY OF LIFE USERS
Neither EGNOSEuropean Geostationary Navigation Overlay Service, its Signal in Space (SISSignal In Space), nor its operator have been certified for safety of life uses, i.e. purposes that have impact on the safety of human life and where a failure in availability, continuity, integrity or accuracy of the EGNOSEuropean Geostationary Navigation Overlay Service SISSignal In Space could cause any kind of direct or indirect personal damage, including bodily injuries or death.
Certification for civil aviation process under SES regulations is under preparation. Consequently until further notice, the EGNOSEuropean Geostationary Navigation Overlay Service SISSignal In Space is broadcast with a message of a type 0 or the equivalent type 0/2 (“Do not Use”) as specified in ICAOInternational Civil Aviation Organisation SARPS.
